The Violet Mena gaming platform (later referred as "Violet Mena") would like to remind all users that you are advised to read this agreement carefully, and you can choose not to conform to this [Agreement]. (The review of this agreement by minors should be done under parental guidance).

Users' acceptance of this agreement or any usage of our services signifies that the users are automatically bound to the Terms of Services set between the users and the Violet Mena party, which includes alterations made on the Terms of Services by the Violet Mena party at any time. All Terms of Services are subjected to amendments by the Violet Mena party and once posted on the website will be deemed effective and substitutes the original Terms of Services agreement.

If the user does not agree with the modifications made on the Terms of Services Agreement, the user should stop using all network services provided by Violet Mena. However, if the user wishes to continue using all Violet Mena network services, the user is required to accept all modifications made on this Terms of Services Agreement.

Agreeing to this agreement also means that the users are aware of and will be cautious in the usage of all game related services as well as non-game related services provided by Violet Mena which includes and not limited to transaction done electronically, usage of any e-materials belonging to Violet Mena, damages and limitations.

Before you register yourself as a user of Violet Mena network services, you are advised to read the contents of this agreement in detail and the continuous usage of any of our services will signify that you agree with the content of this agreement.

1. Acceptance of Terms

By registering, downloading, installing, or otherwise using the Services, you represent and warrant that:

1.1 You are at least 18 years old or have reached the age of majority in your jurisdiction, or you have the consent of a parent or guardian.

1.2 According to the State's user Information Provision, the users are obliged to change their information that is deemed to be untrue or distorted based as required by Violet Mena. However, it should be done out of good faith and the principle of good faith to ensure that no loss is to be encountered by the user and Violet Mena.

1.3 You are at least 18 years old or have reached the age of majority in your jurisdiction, or you have the consent of a parent or guardian.

2. Account Registration and Security

2.1 Account Creation: To use certain features of the Services, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep this information up to date.

2.2 Account Responsibility: You are solely responsible for maintaining the confidentiality of your account credentials (username and password) and for all activities that occur under your account.

2.3 Unauthorized Use: You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

2.4 Multiple Accounts: You are prohibited from creating multiple accounts for the purpose of gaining unfair advantages or circumventing bans or suspensions.

3. User Conduct and Prohibited Activities

You agree not to engage in any of the following activities while using the Services:

3.1 Cheating and Exploitation: Using cheats, automation software, bots, hacks, mods, or any unauthorized third-party software to modify or interfere with the Game.

3.2 Disruption: Engaging in any activity that disrupts or negatively affects the normal operation of the Game or the experience of other users.

3.3 Harassment: Threatening, abusing, harassing, stalking, or intimidating other users, or inciting others to do so.

3.4 Impersonation and Misrepresentation: Impersonating any person or entity or falsely stating or otherwise misrepresenting your affiliation with a person or entity.

3.5 Illegal Activities: Engaging in or promoting any illegal activities, including but not limited to, gambling, hacking, spamming, phishing, or distributing malware.

3.6 Data Mining: Harvesting or collecting any information or data from the Game, including user data or personal information, without our consent.

4. Intellectual Property Rights

4.1 Ownership: All content, features, and functionality of the Services, including but not limited to the Game’s design, text, graphics, logos, images, videos, audio, software, and all other content (“Content”), are the exclusive property of Violet Mena or its licensors. All rights not expressly granted are reserved.

4.2 License to Use: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes, subject to your compliance with these Terms.

4.3 Restrictions: You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works from any part of the Services or the Content without our prior written consent.

5. Virtual Goods and In-Game Currency

5.1 Nature of Virtual Goods: The Game may include virtual goods (such as characters, skins, or items) or in-game currency that you can purchase with real money or earn through gameplay. These virtual goods are licensed to you, not sold.

5.2 Non-Refundable: All purchases of virtual goods and in-game currency are final and non-refundable, except where required by law.

5.3 No Real-World Value: Virtual goods and currency have no real-world value and are not redeemable for cash, tangible goods, or any form of credit.

5.4 Non-Transferable: Virtual goods and in-game currency cannot be transferred between accounts, or outside the Game, whether by sale, gift, trade, or other means, except where explicitly authorized by us.

6. User-Generated Content

6.1 Responsibility for Content: You are solely responsible for any content you submit, post, or display on the Services, including but not limited to text, images, audio, video, and other materials (“User Content”).

6.2 License to Us: By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sub licensable, and transferable license to use, reproduce, modify, adapt, publish, distribute, translate, create derivative works from, and display such User Content in any media.

6.3 Content Guidelines: You agree not to submit User Content that:
- Is obscene, offensive, defamatory, or otherwise objectionable.
- Infringes on the intellectual property or other rights of any third party.
- Contains viruses, malware, or other harmful code.

7. Privacy and Data Protection

7.1 Data Collection: We collect and use personal information in accordance with our Privacy Policy, which forms part of these Terms. By using the Services, you consent to such collection and use.

7.2 Data Security: We implement reasonable measures to protect your personal information from unauthorized access, disclosure, alteration, or destruction. However, we cannot guarantee absolute security.

8. Software Updates and Patches

8.1 We may provide updates, patches and other modifications to the Services that must be installed for you to continue to play our Games properly or at all. We may update, patch or modify the Software remotely and access the Software residing on your machine or device for such purpose, and you hereby grant to Violet Mena the right to deploy and apply such patches, updates and modifications. All provisions of these Terms of Service that refer to “Software” shall also include all such patches, updates and modifications.

8.2 You must always use the latest version of the Software that includes all updates and/or patches provided by us and, to the fullest extent authorized by law, Violet Mena will not be responsible for any loss or damage arising pursuant to your failure to use the latest version or your use of any outdated version of the Software.

9. Termination and Suspension

9.1 Termination by Us: We reserve the right to suspend or terminate your account and access to the Services at our discretion, without notice, for any reason, including but not limited to, a violation of these Terms, illegal or inappropriate conduct, or technical issues.

9.2 Termination by You: You may terminate your account at any time by contacting our customer support team. Upon termination, you must cease all use of the Services.

9.3 Effects of Termination: Upon termination, your right to use the Services will cease immediately, and any data or content associated with your account may be deleted. You will not be entitled to any refunds or compensation for virtual goods, in-game currency, or any unused time.

10. Disclaimers and Limitation of Liability

10.1 No Warranties: The Services are provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the Services will be uninterrupted, error-free, secure, or free from viruses or other harmful components.

10.2 Limitation of Liability: To the fullest extent permitted by law, we shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Services, even if we have been advised of the possibility of such damages.

10.3 Indemnification: You agree to indemnify, defend, and hold harmless Violet Mena , its affiliates, licensors, and service providers from any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising from or related to your violation of these Terms or your use of the Services.

11. Governing Law and Dispute Resolution

11.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law principles.

11.2 Dispute Resolution: Any disputes arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in Asian International Arbitration Centre (“AIAC”), except where prohibited by law. The decision of the arbitrator shall be final and binding.

11.3 Class Action Waiver: You agree to waive any right to participate in a class action or class-wide arbitration.

12. Changes to the Terms

12.1 We reserve the right to modify these Terms at any time. We will provide notice of any changes by posting the updated Terms on our website or within the Game. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms. You are responsible for regularly reviewing these Terms to stay informed of any updates.

13. Severability

13.1 Ownership: All content, features, and functionality of the Services, including but not limited to the Game’s design, text, graphics, logos, images, videos, audio, software, and all other content (“Content”), are the exclusive property of Violet Mena or its licensors. All rights not expressly granted are reserved.

14. Entire Agreement

14.1 These Terms, together with our Privacy Policy and any other legal notices or agreements published by us within the Game, constitute the entire agreement between you and Violet Mena concerning your use of the Services.
